Abstract

This study addresses the rights and public freedoms stipulated in the Jordanian Constitution and their relationship to treaty ratification in Jordan. The legal deductive method was employed to suit the study's objectives.

The concept of rights and public freedoms in Jordanian legislation was identified in light of the study's goals. The legal framework for rights and public freedoms in most countries consists of three legislative texts. Jordan is among the countries that have taken significant and rapid steps in democracy, political pluralism, and human rights. The Jordanian state has accomplished constitutional amendments affecting nearly one-third of the Jordanian Constitution's articles. The study also highlighted a package of legislation covering party laws, elections, public meetings, press and publication laws, the State Security Court law, and establishing the Independent Election Commission as an independent entity overseeing and managing the electoral process, enhancing integrity and transparency. The study revealed Jordan's accession to six of the United Nations' seven major agreements concerning human rights.

The study identified organizations responsible for human rights, such as Amnesty International and the National Center for Human Rights in Jordan. It also highlighted agreements safeguarding human rights, including the Vienna Convention on the Law of Treaties.

The results demonstrated the Jordanian judiciary's stance regarding the status of international agreements, in addition to the position of the Constitutional Court and the opinions of legal scholars in Jordan on issues related to rights and freedoms. The study addressed the legitimacy of signing the casino, Israeli gas, and CEDAW agreements.

The study recommended eliminating ambiguity and confusion by adopting transparency methods to understand the purposes of signing international agreements. It also suggested assessing their successes or failures in a studied manner to maintain and establish trust between the legislative and executive authorities without abusing power, thereby enhancing stability in the Jordanian political system.
