Abstract

This research addresses the legal protection of the right to image in light of the spread of electronic mess through social media sites and smartphone applications that changed the traditional image concept. Human life has become subject to intrusion and violation, thus creating legal, social and moral problems. In these circumstances, as individuals become more aware of the importance of their rights, the importance of the subject appears, mainly since the Jordanian legislature has not dealt with the subject in special legislation. Still, the legal protection has come in scattered legal texts. When a person is subjected to an attack on his/her right to his/her image, he/she has no recourse to the general rules of the Civil Code and the scattered texts of other laws, which raises the problem of providing adequate safeguards for the protection of this right, especially in the light of the rapid and increasing electronic and technological development of our present time. This research is divided into sections: the first deals with the legal protection of the right to image, and the second is devoted to the statement of exceptional cases that permit the dissemination of images without responsibility. Eventually, the work reaches certain results and recommendations, including the need to expand and strengthen the legal protection of the right to image by introducing explicit and strict legal texts that provide adequate safeguards for the protection of this right as well as the protection of individuals in order to avoid any future problems in the light of the rapid and advanced technological and electronic development.
