Administrative Judiciary Oversight of Executive Systems

This study aims to identify the nature of the executive regulations and indicate the extent to which they can be subject to the supervision of the administrative judiciary. The study examined the method of descriptive and analytical approaches. The study concluded with some results, the most important being that administrative judicial oversight of executive regulations is more appropriate than constitutional judicial oversight, given the nature of such regulations. The administrative judge's powers in this area are broader than the constitutional judge's. The study recommended that the Jordanian legislature reconsider the text of article 34 (b) of the Code of Administrative Justice, that the issue of the retroactive effect of decisions to repeal executive regulations be given particular importance and that the administrative judge be left with a broader power to assess the date on which the judgement abolishing the executive system takes effect, given the retroactive impact on legal status and acquired rights.
