The Jordanian legislator specified the private rules of case expenses in Jordanian Civil Procedure Law. The term "Expenses" means: the basic expenses of the case process in the court of law according to articles 161-166 of the civil procedures law.
According to these articles, the party who loses the case pays these expenses in spite of his status as a plaintiff or defendant. More over, the criteria of paying these expenses differ according to the subject of the case, number of parties in law suit, existence of counter claim, compulsory and optional interference in the case.
In its final decision, the court specifies which party pays these expenses, including the lawyer fees, even if the concerned lawyer did not ask for these fees.
