The consumer's abstention from the E-contract : a comparative study in Jordanian and French law

Abstract

This research is a comparative study between Jordanian law and French law regarding the consumer's right to resend e-contract as "in-absence contracting".

The first Chapter of this study analyses the legal provisions that govern this subject under the French consumption Act, and particularly, addresses the definition of such right, its scope, the applicable rules, and a comparison between this right and the other similar legal concepts.

The second Chapter clarifies the Jordanian law with respect to the consumer's right mentioned above in terms of the possibility to cover this right under the general rules and principles of Jordanian civil law.

In addition, it studies the legal provisions that govern this subject in the suggested bill of Jordanian consumer protection law of 2007.

As conclusion of this study, the researcher suggests some recommendations, the most important of which is the necessity to extend the scope of the consumer's right to resend the e-contract so as to cover the sale of services and goods.

He also suggests that the consumer's right to resend e-contract shall not requir or stipulate the existence of defect in the sold property.
